1. Terms of Use
By accessing Security Cloud (both mobile and PC versions), you expressly agree to be bound by these Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable laws of Hong Kong Special Administrative Region of the People’s Republic of China. If you do not agree with any of these terms, you are prohibited from using or accessing this application.
2. Definitions
a) “Licensed Application” refers to Security Cloud.
b) “Service Providers” refers to affiliates, service providers, partners and other third parties, in and out of Hong Kong, who provide service for the Licensed Application through contractual agreements.
3. Disclaimer
The materials on the Licensed Application are provided “AS IS” and on an “AS AVAILABLE” basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. Without limiting the foregoing, Chamber of Security Industry Limited makes no warranty or representation that this application will always be available, accessible, uninterrupted, timely, secure, accurate, complete or error free or that this application is free of viruses or other harmful components or that any defects in this application will be corrected. You expressly understand and agree that your use of the Licensed Application is at your own risk. Chamber of Security Industry Limited disclaims any and all liability for the acts, omissions and conduct of any third parties in connection with or related to your use of the Licensed Application and you assume total responsibility for your use of the Licensed Application and any linked sites. Any contents downloaded or otherwise obtained through the use of the Licensed Application are obtained at your own discretion and risk and that you will be solely responsible for any damages to your device or loss of data that result from the download of such contents. No advice or information, whether oral or written, obtained by you from Chamber of Security Industry Limited or through the provision of services of the Licensed Application shall create any warranty not expressly stated in these terms and conditions. We do not authorize anyone, including but not limited to Chamber of Security Industry Limited employees, to make any warranties on our behalf and you should not rely on any such statements. Because some jurisdictions do not permit the exclusion of certain warranties, these exclusions may not apply to you.
4. Limitations
To the extent permitted by law, Chamber of Security Industry Limited and the suppliers of the Licensed Application shall not be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on the Licensed Application, even if its corporation authorized
representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
5. Revisions and Errata
The materials appearing on the Licensed Application may include technical, typographical, or photographic errors. This application does not warrant that any of the materials on its application is accurate, complete, or current. This application may make changes to the materials contained on its application at any time without notice. This application does not, however, make any commitment to update the materials.
6. Links
Both Chamber of Security Industry Limited and supplies of the Licensed Application have not reviewed all of the sites linked to Security Cloud Internet web site of the Licensed Application and therefore are not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by the Licensed Application. Use of any such linked web site is at the user's own risk.
7. Application Terms of Use Modifications
The Licensed Application Security Cloud may revise these terms of use for its application at any time without notice. By using this application, you expressly agree to be bound by the then current version of these Terms and Conditions of Use.
8. Intellectual Property
This application contains proprietary and confidential information that is protected by intellectual property laws. Chamber of Security Industry Limited retains exclusive ownership of this application and all intellectual property therein, including without limitation, any trademarks, service marks, trade dress, symbols, logos, other identifying indicia, patents, copyright, trade secrets, whether or not registered and anywhere in the world. Chamber of Security Industry Limited reserves all rights. Further, you may not copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application.
9. Indemnification
You agree to indemnify, release and hold Chamber of Security Industry Limited harmless from any and all liability, losses, damages or claims of any kind resulting from or arising out of your (a) use of this application, (b) breach of these Terms and Conditions of Use, or (c) violation of another person’s or entity’s rights. In addition, you agree that Chamber of Security Industry Limited shall not be responsible for any third party claims against you that arise from your use of this application and you agree to reimburse Chamber of Security Industry Limited for all costs and expenses related to the defense of any such claims, including reasonable legal fees. This section will survive the expiration or termination of these Terms and Conditions of Use.
10. Governing Law and Jurisdiction
These Terms and Conditions of Use are governed by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China, without regard to its choice of laws and rules. This governing law provision applies no matter where you reside, or where you use this application. The parties hereby submit to the jurisdiction of the Hong Kong Courts.
